Terms of Service

ResqRide ("we", "us", "our") is an on-demand roadside assistance platform that connects drivers who need help ("Drivers") with independent service providers ("Providers"). ResqRide is a technology platform, not a roadside assistance company. We do not directly perform roadside services.

You must be at least 18 years old to use ResqRide. By creating an account, you represent that:

• You are at least 18 years of age
• You have the legal right and capacity to enter into these Terms
• All information you provide is accurate and complete
• You will comply with all applicable laws and regulations

As a Driver using the ResqRide platform:

• You agree to pay the quoted price for any service you request before a Provider is dispatched
• You are responsible for ensuring your vehicle information is accurate
• Cancellation of a confirmed request may result in a cancellation fee
• Tips are optional and go directly to the Provider
• ResqRide is not responsible for the quality of services performed by independent Providers, though we maintain a verification process and rating system

As a Provider offering services through ResqRide:

• You must complete our identity and background verification process before accepting jobs
• You are an independent contractor, not an employee of ResqRide
• You are responsible for maintaining all required licenses, certifications, and insurance for the services you provide
• ResqRide retains a platform fee (15%, or 10% for priority jobs) from each completed job
• Earnings are credited to your ResqRide balance and can be cashed out via Stripe. Minimum payout is $5
• Accounts found to be fraudulent or misrepresenting qualifications will be permanently banned

All payments are processed securely through Stripe. By adding a payment method, you authorize ResqRide to charge the stated amount for services requested.

Refunds are available if a Provider fails to arrive or the service is not completed as described. Refund requests must be submitted within 24 hours of the service window. ResqRide reviews all refund requests on a case-by-case basis.

ResqRide Premium subscriptions are billed monthly or annually. You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused subscription time unless required by law.

You agree not to:

• Use the platform for any unlawful purpose
• Harass, threaten, or harm other users or Providers
• Submit false service requests or fraudulent payment information
• Attempt to circumvent the platform's fee structure by transacting with Providers outside ResqRide
• Reverse engineer, scrape, or interfere with the ResqRide platform

ResqRide is a marketplace technology platform. To the fullest extent permitted by law, ResqRide is not liable for:

• The quality, safety, or legality of services performed by Providers
• Personal injury or property damage arising from services rendered through the platform
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the amount you paid to ResqRide in the 90 days preceding the claim.

Any disputes between Drivers and Providers should first be raised with ResqRide support. We will make a good-faith effort to mediate. Disputes that cannot be resolved through our internal process will be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English in the state of Delaware.

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or at our sole discretion with or without notice. You may delete your account by contacting support.

We may update these Terms from time to time. We will notify you of material changes via the app or email at least 14 days before the effective date. Continued use of ResqRide after the effective date constitutes acceptance of the updated Terms.
